Albemarle County is seeking feedback on Fill and Waste Regulations

Albemarle County is reviewing the regulations adopted in 2020 that address the placement of fill and waste. The Community Development Department is preparing a report for the Board of Supervisors outlining the projects that have been evaluated for compliance with fill and waste regulations since the adoption.

Whether you have been involved in an application for fill and waste either as an applicant or are interested in fill and waste activities, we want to hear what you think about the regulations and process.

If interested, please provide written comments for inclusion in a report that will be distributed to the Board of Supervisors at the November 15, 2023 board meeting. The Board of Supervisors will not be discussing fill and waste at this meeting -- the information collected will be provided along with a recommendation for future steps.

What is Fill and Waste?

Fill and waste activities may involve the disposal of excess soil and rock generated from grading projects or the disposal of inert materials such as rubble, concrete, bricks, broken bricks and blocks, and asphalt pavement from construction or demolition projects. The trucking and placement of this material may impact not only the property involved in the disposal but the roads and properties near the disposal activity. In the Rural Area of the County only soil and rock may be disposed of by-right.

The County has regulations that address how fill and waste activities occur. These regulation address issues such as the maximum area used, setbacks, minimum lot size, access standards, tree canopy requirements, and hours of operation.
