Help Shape Data Centers Regulations for our Community

Albemarle County is initiating a public process to review and update zoning regulations for data centers, which are buildings that store and process digital information for various purposes, including email and cloud storage. As demand for these facilities increases, the County is taking a proactive approach to ensure that any potential data center development aligns with our community’s values and priorities.

Why is this being considered?

This is about planning for the future. We are preparing for potential data centers in our community, specifically considering where and how they could be developed. This work is also part of a broader effort to diversify our economy, reduce long-term tax burdens on residents, and ensure that any development is within designated areas.

Why is this important?

Data centers can provide a more diversified economy and tax base. However, they also have unique features and impacts that differ from other types of development:

  • They typically operate 24/7 and require uninterrupted power.
  • Cooling systems can generate noise or require substantial amounts of water.
  • Buildings are often large, with few windows or doors.
  • They generate low traffic and have fewer on-site employees.

These characteristics can affect surrounding neighborhoods, infrastructure, and the environment. That’s why the County is reviewing how and where data centers are allowed and what standards they must meet.

What is the County considering?

Through this review, the County is exploring updates to zoning regulations. Some examples of what these regulations could address include:

  • Appropriate zoning districts for data centers
  • Maximum building size and height
  • Noise limits and generator restrictions
  • Visual screening, landscaping, and building design
  • Environmental considerations related to cooling systems

The goal is to establish clear and thoughtful rules that promote innovation and economic growth while minimizing negative impacts on the community.

Review Process

  1. Staff Research and Concept Development: County staff are currently researching the impacts of data centers and current regulations to develop a draft of possible future regulations.
  2. Community Review of Concepts: A virtual learning session will be held on June 16, and an in-person open house will be held on June 30, to allow community members to learn about potential regulations and provide feedback.
  3. Community Review of First Draft: Staff will review the comments received and draft an ordinance for further consideration. This draft will be shared with the community on Engage.Albemarle.org and discussed at a work session with the Board of Supervisors, which is expected to be held in August.
  4. Community Review of Revised Draft: Staff will further revise the ordinance and provide public opportunities for review and comment.
  5. Community Review and Public Hearings for Proposed Ordinance: In the fall, the Planning Commission and the Board of Supervisors will conduct public hearings to consider the proposed ordinance. Community members are invited to share final comments at these public meetings.
